ArchFine respects the intellectual property rights of others and expects its users to do the same. This policy outlines how we handle copyright infringement claims in accordance with the Digital Millennium Copyright Act (DMCA) and addresses the unique considerations of AI-generated content.

1. Our Commitment to Copyright Protection

ArchFine is committed to complying with the DMCA and other applicable copyright laws. We will respond promptly to notices of alleged copyright infringement that comply with the DMCA and this policy. We may remove or disable access to material that is claimed to be infringing and may terminate the accounts of repeat infringers.

2. AI-Generated Content and Copyright

ArchFine uses artificial intelligence to generate architectural renderings and visualizations based on user prompts and inputs. Users should be aware of the following considerations regarding AI-generated content:

  • Ownership of AI Outputs: The legal status of copyright in AI-generated works is evolving and varies by jurisdiction. ArchFine does not make any representation or warranty regarding the copyrightability of AI-generated outputs. Users are responsible for understanding the copyright implications in their jurisdiction.
  • No Intentional Copying: Our AI models are designed to generate original outputs. However, AI-generated images may occasionally bear resemblance to existing copyrighted works. If you believe an AI-generated output infringes your copyright, please follow the takedown procedures described below.
  • User Responsibility: Users are solely responsible for ensuring that their use of AI-generated content (including in commercial projects, client presentations, and publications) complies with applicable copyright laws and does not infringe upon the rights of third parties.
  • Input Material: Users must not upload copyrighted material belonging to third parties as input to the AI system without proper authorization. Uploading copyrighted reference images, plans, or designs without the right to do so may constitute infringement.

4. Filing a DMCA Takedown Notice

If you believe that content available on or through ArchFine infringes your copyright, you may submit a written DMCA takedown notice containing the following information:

Identification of the Copyrighted Work

Identify the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.

Identification of the Infringing Material

Identify the material you claim is infringing and provide sufficient information for us to locate it (e.g., URL, user account, rendering ID, or screenshot).

Your Contact Information

Provide your full name, mailing address, telephone number, and email address.

Good Faith Statement

Include a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

Accuracy Statement

Include a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

Signature

Provide a physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys’ fees.

5. Our Response to DMCA Notices

Upon receiving a valid DMCA takedown notice, ArchFine will:

  • Promptly remove or disable access to the allegedly infringing material.
  • Notify the user who uploaded or generated the content that the material has been removed.
  • Provide the user with information about how to file a counter-notification if they believe the removal was in error.

For AI-generated content specifically, we will also review the generation parameters and prompts to determine if the output was the result of a user attempting to replicate copyrighted material, and may take additional action as appropriate.

6. Counter-Notification

If you believe your content was removed in error or that you have the right to use the material, you may file a counter-notification with the following information:

  • Your physical or electronic signature.
  • Identification of the material that was removed and its location before removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification.
  • Your name, address, telephone number, and a statement consenting to the jurisdiction of the federal court in the district where your address is located (or if outside the U.S., any judicial district in which ArchFine may be found), and that you will accept service of process from the person who filed the original takedown notice.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, we will restore the removed material.

7. Repeat Infringer Policy

ArchFine maintains a policy to terminate accounts of users who are repeat infringers. We define a repeat infringer as a user who has been the subject of two or more valid DMCA takedown notices. Account termination is at ArchFine’s sole discretion and may include:

  • Permanent suspension of the user’s account.
  • Forfeiture of remaining credits and subscription balance.
  • Prohibition from creating new accounts.

8. Prohibited Uses Related to Copyright

The following uses of ArchFine are strictly prohibited:

  • Deliberately attempting to replicate copyrighted architectural designs, photographs, or artworks through AI prompts.
  • Uploading copyrighted reference images without proper authorization.
  • Using ArchFine to create derivative works of copyrighted material without the right to do so.
  • Misrepresenting AI-generated content as original photography or as the work of a specific architect or designer.
  • Using AI-generated renderings to infringe upon the moral rights or attribution rights of architects and designers.

9. Architectural Copyright Considerations

Architecture and architectural works may be protected by copyright under the Architectural Works Copyright Protection Act (AWCPA). Users should be aware that:

  • Original architectural designs, plans, and drawings may be protected by copyright.
  • The visual appearance of certain buildings may be protected.
  • Using ArchFine to generate renderings that closely replicate the distinctive design of a specific copyrighted building or project may constitute infringement.
  • However, individual building elements that are functionally required (e.g., standard windows, doors, structural elements) are generally not copyrightable on their own.

10. International Copyright

ArchFine operates globally and acknowledges that copyright laws vary by jurisdiction. While this policy is primarily based on U.S. copyright law and the DMCA, we will also consider and comply with applicable copyright laws in other jurisdictions, including the EU Copyright Directive and equivalent laws in other countries where our users are located.

11. Good Faith and Fair Use

When evaluating takedown notices and counter-notifications, ArchFine will consider potential fair use defenses in good faith. We recognize that certain uses of copyrighted material may be permissible under fair use or equivalent doctrines, including uses for criticism, commentary, education, and research. However, determination of fair use is ultimately a legal question that may require judicial resolution.

We may update this DMCA & Copyright Policy from time to time to reflect changes in law, technology, or our practices. We will post the updated policy on our website and update the “Last Updated” date.
