2. AI-Generated Content and Copyright
ArchFine uses artificial intelligence to generate architectural renderings and visualizations based on user prompts and inputs. Users should be aware of the following considerations regarding AI-generated content:
- Ownership of AI Outputs: The legal status of copyright in AI-generated works is evolving and varies by jurisdiction. 5. Our Response to DMCA Notices
Upon receiving a valid DMCA takedown notice, ArchFine will:
- Promptly remove or disable access to the allegedly infringing material.
- Notify the user who uploaded or generated the content that the material has been removed.
- Provide the user with information about how to file a counter-notification if they believe the removal was in error.
For AI-generated content specifically, we will also review the generation parameters and prompts to determine if the output was the result of a user attempting to replicate copyrighted material, and may take additional action as appropriate.
6. Counter-Notification
If you believe your content was removed in error or that you have the right to use the material, you may file a counter-notification with the following information:
- Your physical or electronic signature.
- Identification of the material that was removed and its location before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification.
- Your name, address, telephone number, and a statement consenting to the jurisdiction of the federal court in the district where your address is located (or if outside the U.S., any judicial district in which ArchFine may be found), and that you will accept service of process from the person who filed the original takedown notice.
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, we will restore the removed material.
7. Repeat Infringer Policy
ArchFine maintains a policy to terminate accounts of users who are repeat infringers. We define a repeat infringer as a user who has been the subject of two or more valid DMCA takedown notices. Account termination is at ArchFine’s sole discretion and may include:
- Permanent suspension of the user’s account.
- Forfeiture of remaining credits and subscription balance.
- Prohibition from creating new accounts.
8. Prohibited Uses Related to Copyright
The following uses of ArchFine are strictly prohibited:
- Deliberately attempting to replicate copyrighted architectural designs, photographs, or artworks through AI prompts.
- Uploading copyrighted reference images without proper authorization.
- Using ArchFine to create derivative works of copyrighted material without the right to do so.
- Misrepresenting AI-generated content as original photography or as the work of a specific architect or designer.
- Using AI-generated renderings to infringe upon the moral rights or attribution rights of architects and designers.
9. Architectural Copyright Considerations
Architecture and architectural works may be protected by copyright under the Architectural Works Copyright Protection Act (AWCPA). Users should be aware that:
- Original architectural designs, plans, and drawings may be protected by copyright.
- The visual appearance of certain buildings may be protected.
- Using ArchFine to generate renderings that closely replicate the distinctive design of a specific copyrighted building or project may constitute infringement.
